Terms of Service

These Terms of Service (“Terms”) govern your access to and use of hardmoneylenderorlando.com (the “Site”), which is operated by Lead Skills, LLC d/b/a Hard Money Lender Service of Orlando(“we,” “us,” or “our”). By accessing the Site, submitting an inquiry, or otherwise using any features offered on the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site.

We operate a lead-generation service. We connect consumers and real estate investors with participating hard money lenders that may be able to provide financing.

We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All lending activities, including evaluation of the borrower and the property, loan approval, pricing, document preparation, closing, and funding, are performed by participating lenders or their authorized affiliates and are governed by agreements between you and those third parties.

Nothing on the Site constitutes an offer or solicitation to lend, an offer of credit, or a commitment to extend credit. Information on the Site is provided for general informational purposes only and is not a substitute for advice from a qualified professional. Availability of any loan program, rate, term, or feature is subject to participating-lender approval and may change without notice.

By using the Site or submitting an inquiry, you represent and warrant that:

• You are at least 18 years old and legally able to enter into a binding contract.
• The information you provide is true, accurate, and complete, and belongs to you or you have authority to submit it.
• You are not submitting the information for an unlawful purpose.

We reserve the right to refuse service, terminate accounts, or decline to forward inquiries at our sole discretion.

When you check the “Consent to Contact” box on a form and click Submit, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies.

You can opt out at any time by replying STOP to any text message or by calling 407-250-8939. Additional opt-out instructions are available in our Privacy Policy.

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

You agree not to:

• Submit false, misleading, or fraudulent information.
• Submit another person's information without authorization.
• Use the Site to violate any applicable law or regulation.
• Interfere with or disrupt the Site or the servers or networks that host it.
• Attempt to gain unauthorized access to any portion of the Site or related systems.
• Use automated means (such as bots or scrapers) to access the Site except as permitted by our robots.txt file.
• Reverse engineer, decompile, or disassemble any portion of the Site.

The Site and all content, features, and functionality on it (including text, graphics, logos, images, and software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws. You may use the Site for your personal, non-commercial use in connection with a financing inquiry. Any other use — including reproduction, modification, distribution, or republication — without our prior written consent is prohibited.

The Site may contain links to third-party websites, including sites operated by participating lenders, or integrate third-party services. We do not control those sites or services and are not responsible for their content, products, privacy practices, or availability. Your use of any third-party site or service is governed by that third party's terms and privacy policy.

THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT YOU WILL BE MATCHED WITH A LENDER OR RECEIVE A LOAN OFFER.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY ACTIONS TAKEN BY PARTICIPATING LENDERS OR OTHER THIRD PARTIES, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

You agree to indemnify, defend, and hold harmless Lead Skills, LLC, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any information you submit through the Site.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Site after an update becomes effective means you accept the updated Terms.
